Why Pro Se Filers Are Gold.
A pro se patent filer is someone who submitted a patent application WITHOUT an attorney. They are either: saving money (budget-conscious), unaware they need help (naive), or previously burned by an attorney (skeptical). All three are convertible with the right approach.
Segmentation Strategies.
- By technology class. Only reach out to inventors in YOUR area of expertise. A biotech attorney should not contact a software inventor.
- By filing recency. Within 30 days of filing = still actively engaged. After 90 days = may have moved on.
- By filing history. First-time filers convert 3x better — they do not know the process. Serial pro se filers are intentionally doing it alone.
- By geography. Local inventors are easier to convert (in-person meetings, local bar membership).
The Approach That Works.
Do NOT lead with "you need an attorney." Lead with value:
- "I noticed your filing on [invention]. I work with inventors in [their field] and wanted to share some common pitfalls I see in claim construction."
- Offer a free 15-minute claim review. No obligation. This builds trust.
- Show them ONE specific issue in their filing that a professional would catch. Now they see the value.
Timing Windows.
- Days 1-30: Highest conversion. Still excited about their invention. Open to help.
- Days 31-60: Good. Waiting for USPTO response. Starting to realize complexity.
- Days 61-90: Moderate. May have received office action they do not understand.
- 90+ days: Lower conversion unless triggered by office action or rejection.
